Job Description:
 Background
Lawyers for Human Rights (LHR) is an Ethiopian civil society organization that re-registered on September 19, 2019, before the FDRE Civil Societies Organizations Agency in accordance with Proclamation No. 1113/2019. The objective of the Organization is to promote and advocate human rights among others through increasing the participation and contribution of lawyers in the area of human rights through training and other capacity-building activities and supporting and helping lawyers across the nation to exchange ideas, information and experience for better protection of human rights and prevalence of human rights; litigating before courts and other relevant organs to ensure protection and promotion of human rights recognized under the FDRE Constitution and other laws; creating awareness for justice organs about international human rights instruments ratified by Ethiopia; providing free or low-cost legal services for victims of human rights violation, particularly disadvantaged communities; lobbying the government to enact new laws or amend existing ones to give full protection for human rights; and familiarizing the idea of human rights defenders (HRD) among the lawyers.

To achieve its objectives, LHR has been engaging with national and international stakeholders in the past years including National Endowment for Democracy (NED), Open Society Initiative for Eastern Africa (OSIEA), USAID’s Feteh (Justice) Activity in Ethiopia, Freedom House (FH), Konrad Adenauer Stiftung (KAS) and recently with Open Society Policy Center (OSPC). 

Currently, LHR is implementing a project that aims to guarantee the implementation of human rights. One of the rights LHR aspires to work on its implementation is the right to education of children with autism. According to international instruments, education is not a privilege rather it is a human right. It is essential for the exercise of all other human rights and promotes individual freedom and empowerment. It is also a powerful tool by which economically and socially marginalized adults and children can lift themselves out of poverty and fully participate in their community.  

This right is guaranteed in the Universal Declaration of Human Rights (UDHR), International Covenant on Civil and Political Rights (ICCPR), International Covenant on Economic, Social and Cultural Rights (ICESCR), Convention on the Right of the Child (CRC), Convention on the Elimination of all forms of Discrimination Against Women (CEDAW), African Charter on Human and Peoples Right (ACHPR), and African Charter on the Right and Welfare of the Child (ACRWC). All these instruments guaranteed the right to education without discrimination based on disability. The Convention on the Rights of Persons with Disabilities (CPRD) furthermore calls state parties to recognize the right to education of individuals with disabilities and ensure an inclusive education level at all levels.  Ethiopia has ratified all these international instrument that recognize the right to education. 

According to the literature although the right to education for Children with Autism (CWA) is guaranteed under international instruments the level of implementation of this right still suffers greater challenges in Ethiopia. The number of children with autism who have access to education in Ethiopia is very low. The level of implementation of the right is far from reality, especially in regions and cities outside of Addis Ababa. Hence, LHR is looking for a qualified consultant who could conduct background research that assesses the implementation of the rights to education of children with autism in Dire Dawa City.

 Objective 
The overall objective of the consultancy services is to assess the implementation of the right to education of children with autism in Dire Dawa City urban areas. Hence, the consultant is required to analyze the scope and content of the right to education of CWA in the relevant national and international norms, the obligation of the governments towards its realization, the available legal and institutional frameworks to guarantee the right to education to CWA and whether the education system in Dire Daw is inclusive of children with disabilities. The findings and recommendations of the study will be used to advocate for legal and institutional reforms that will guarantee inclusive and special education for children with autism in Dire Daw City.

 The scope of the work
The consultant will conduct empirical background research on the right to education of children with autism in Dire Dawa City urban areas. In carrying out the research the consultant will carry out the following tasks
  •  Review of relevant national, regional, and international legal instruments on the right to education of children with autism;
  • Analyze the obligation of the Ethiopian government in general and Dire Dawa City Administration and other stakeholders in particular in guarantying inclusive and meaningful education to children with autism;
  • Analyzing the legal frameworks of the city administration;
  • Asses to what extent the Dire Dawa city Administration and other relevant stakeholders discharged their obligation towards the realization of the right to education of children with autism;
  • Assess whether there are legal and institutional gaps in guarantying special and inclusive education to children with autism in Ethiopia in general and Dire Dawa City;
  • Conduct case studies on the violation of the right to inclusive education of the rights of persons with disabilities in Dire Daw City and recommend remedies for the violations;
  • Examine the current situations of children with autism in Dire Dawa City from the perspective of accessing education;
  • Assess the implication of violations of the right to education of children with disabilities;
  • Suggest intervention areas that the federal government as well as the Dire Dawa City Administration and CSOs should take to ensure the right to inclusive education of children with autism is guaranteed. 

 Expected Results and Deliverables

The consultant will provide the following deliverables:
  • Inception report which contains the possible contents of the research, methodology, and work plan with a timeframe.
  • Draft research report. The Consultant shall include the comments of LHR on Draft Report.
  • Presentation of the research findings in an expert meeting to be organized by LHR and incorporating comments to be given at expert meetings;
  • Final research output; 
Timeframe
  • The level of effort for this assignment is 25 working days.
Job Requirements:

 Required qualifications 

The applicants who want to compete in conducting the research should meet the following qualifications and competencies:

  •  At least a Master’s Degree in Law preferably with a focus on human rights, rights of persons with disabilities, and preferably with equivalent research experience;
  • Proven experience in research and experience working with human rights, rights of persons with disabilities topics and the right to education topics;
  • Well, informed about the social and human rights approach to the right to inclusive education and understanding of contemporary human rights and the socio-political context of Ethiopia; and
  • Fluency in both written and spoken English.
