Terms of Reference to Hire Individual Legal Advisor For KPP Support Group Formation

Background

ISHDO is implementing CSO capacity building and KPP Combination HIV prevention project aimed at contributing to national three 95 goals. KPP support Group Formation is one of the millstones of the Project. CSOs and KPP groups needs to play pivotal role in the scale-up of combination HIV prevention services, monitor quality, accessibility and friendliness of combination HIV services.  CSOs  and  KPPs  engagement  in  the  advocacy  and  implementation  of  combination  HIV prevention services is very critical for success of the National HIV program. However, their engagement has been challenged with lack of capacity and supportive environment. Key and priority populations has not been organized formally either because of social or legal factors. Organizing KPPs in a support group will create strong platforms for meaningful engagement of KPPs in advocacy, planning and implementation of combination HIV prevention interventions.  In addition, CSOs and KPP groups has to play significant role in implementation of combination HIV prevention interventions using innovative strategies for KPP groups currently less targeted by different parties such as High-Risk adolescent girls at universities and industrial parks, PWID and HIV positive adolescents and youth. CSOs and KPP groups are in a better position for policy advocacy and community lead monitoring of the HIV prevention, care and treatment program.  Thus it is important to form Therefore, the project will support, KPP support groups formation for each KPPs ( including FSWs, PWID, HRGYW and HIV positive adolescents and youth of selected woredas).  Thus, KPP support group will be formed, nurtured and supported.

The Legal service expected from the consultant will be

Major tasks of the consultant mobile

The consultant will accomplish the following key tasks

• Identify and interpret relevant legislation for association and support Group formation to institute Key and Priority Population vulnerable to HIV/AIDS.
• Support and execute legal licensing and registration process of the KPP Support group formation
• Present facts in writing and verbally to KPP Support group and represent on behalf of the Support Group in the process of establishing support groups,
• Prepare and submit bi-laws article of association and memorandum
• Draft, review, and negotiate a diverse range of agreement, and file comprehensive complaints and airtight responses
• Work closely with team to prepare accurate, persuasive briefs and motions for every case that goes to trial
• Conduct research and analysis of legal problems among KPP Support group and government lows & polices
• Inform clients about discovery, depositions, trial preparation, and other case-related procedures
• Collect documents for the legal procedure
• List out formalities for legal license of the support group
• Orient and trainee support group members and coordinators on their rights and responsibilities that help to know their scope and responsibility in how they managing the association   
• Report timely the progress of the legal licensing process of the support group

Deliverables

There will be two major deliverables out of the consultancy service:

•  established support groups or Association as per pertinent Ethiopian law in Addis Ababa, Dire dawa, Oromia and Harari Regions.
•  Complete issues related with gaining legal personality and related legal process of the KPP support groups of different target group 
• Trainee and empower the support group members to become self-reliant in understanding legal aspects of running their institution,  
•  Bi-laws developed for all KPP support groups or Associations in above mentioned cities and regions

Time line

• The timeline for conducting the legal assistance will be from May, 2023 to August 2023.  

Key requirements and descriptions of Qualifications and Experience: 

The consultant is expected to have the following expertise, qualifications and competencies: 

• LLB or advanced degree from recognized University degree
• Minimum of 6 years of experience in the field of establishing support groups, associations and developing bi-law
• Experience in providing legal service assistance of forming new associations   
• Excellent interpersonal and communication skills
• Excellent legal report writing skills
