Terms of Reference for Research Consultancy on “The significance of ratifying the Singapore convention on mediation and the experiences of other states; comparative perspective”

Project Background

Ethiopian mediation and arbitration centre (EMAC): Ethiopian Mediation and Arbitration Centre (EMAC) is a Civil Society Organization that was established with the intention of promoting and providing alternative dispute resolution (ADR) in Ethiopia, contribute to the transformation efforts of the government in the Justice System and legal service delivery patterns of the country. The centre in collaboration with USAID Fitih Activity is working to further build on its achievements in the areas of conflict resolution, promotion of peaceful co-existence and improved conditions for the marginalized. The center works to promote accessible alternative dispute resolution mechanisms including mediation to contribute to peace processes and access to justice by targeting various in need members of communities. Through the promotion of accessible mediation and arbitration, the centre provides and facilitates the resolution of disputes in a non-adversarial environment, by providing a service that is less costly and time saving than court litigation.

Promote access to justice through a workable Alternative Dispute Resolution (ADR) system Project:

Promote access to justice through a workable Alternative Dispute Resolution (ADR) system Project, developed by EMAC and funded by the United States Agency for International Development (USAID) Feteh (Justice) Activity is part of the overall goal of supporting and strengthening of the rule of law in Ethiopia by providing flexible, rapid response technical assistance to selected judicial institutions.

As part of its objective of supporting judicial institutions and bringing legal reform in Ethiopia concerning ADR, EMAC in collaboration with Fitih activity (USAID) is working on i.e., the adoption and implementation of ADR law reform for consistency and effectiveness of the provision of the service across the country, build the capacity of courts focusing on Amhara Regional Court and FSC by organizing consultations and creating a link between the Federal Supreme Court and Amhara Regional Court to effectively adopt CAM, and  promoting ADR in Ethiopia, and make it available to the wider public, including the marginalized and the vulnerable. In achieving one of its objectives under this project EMAC wanted to hire a consultant to conduct a mini research on the necessity of ratifying the Singapore convention on mediation through taking best experiences of states that are parties to the convention. 

Overall Research Objective:

  • The overall, objective of this mini research is to discuss the basic components of the Singapore convention on mediation and examine the importance of its adoption in Ethiopia through taking the experiences of other states. 

Specific research Objectives

  • Examine the basic concepts and elements of the Singapore convention on mediation.
  • Assess the experiences of other states that are a party to the convention.
  • Assess the existing practice and gaps of deploying mediation in Ethiopia.
  • Exploring the possible benefits of ratifying the convention based on the international practice.

Job Requirements:

Expected Qualifications

The consultant or the consulting team should have the following experience and formal qualifications:

  • Master’s degree or degree with equivalent experience in Law (LLB., LLM)
  • Knowledge and experience in the area of Alternative Dispute Resolution (ADR)
  • At least five years of proven experience in carrying out legal researches/study  
  • Proficiency in qualitative methods of data collection
  • Proven experience with comparative and qualitative data analysis
  • Excellent command / highly proficient in spoken and written English.
